Understanding the Visa Bulletin

The Department of State publishes a monthly Visa Bulletin showing priority dates — the cutoff date for when immigrant visa numbers are available in each employment and family preference category.

What is a priority date?

A priority date is generally the date USCIS received an I-140 petition (or the date a labor certification application was filed with DOL). For family-based immigration, it is the date the I-130 petition was filed. To apply for a green card, your priority date must be earlier than the "Final Action Date" shown in the Visa Bulletin for your category and country of birth.

What is the difference between "Final Action Dates" and "Dates for Filing"?

"Final Action Dates" indicate when a visa number is actually available for USCIS to approve permanent residence. "Dates for Filing" show an earlier date when USCIS may allow advance filing of the I-485 (adjustment of status). USCIS announces each month whether the Dates for Filing chart may be used. Not all months permit advance filing.

Why is the India EB-2 backlog so severe?

Per-country annual limits mean that no single country can receive more than 7% of the approximately 140,000 employment-based green cards available each year (about 9,800 visas). India — which accounts for over 70% of all employment-based petitions — is therefore severely limited by this per-country cap. The backlog has grown for decades; USCIS estimates some applicants may wait 50–100+ years under current demand if no legislative fix is enacted.

Can I work while my I-485 is pending?

Yes. Upon filing a concurrent I-485 + I-765 (EAD application), USCIS issues a receipt notice. Once the I-765 is approved (typically 150–210 days), you receive an Employment Authorization Document (EAD) allowing work for any employer. Some workers maintain H-1B status in parallel to preserve portability protections.

What is "job portability" under AC21?

Under the American Competitiveness in the 21st Century Act (AC21), if an I-485 has been pending for 180+ days and an I-140 has been approved, the applicant may change employers or job roles as long as the new position is in the "same or similar occupational classification." This allows flexibility without losing your priority date or pending green card application.
